We will review valid notices promptly and, where appropriate, remove or replace the content in question.

7. Editorial independence

All reporting, commentary, rankings and articles are produced independently. Advertising may support the publication, while paid placements and sponsored content are clearly labelled and kept separate from editorial decisions. The views expressed are our own and do not represent the views of any company mentioned in our articles.

8. Third-party links

The Service may contain links to third-party websites or services that we do not own or control. We do not control, and are not responsible for, their content, accuracy, privacy policies or practices. We are not liable, directly or indirectly, for any damage or loss caused by or in connection with your use of or reliance on any third-party websites or services.

9. Disclaimer

Your use of the Service is at your own risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and course of performance.

  • We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.
  • Content does not constitute professional financial, legal or purchasing advice.
  • Specifications, prices and rules change frequently and vary by market — always verify against official sources before making decisions.
  • We are not responsible for the consequences of any decision made on the basis of our content.

10. Limitation of liability

In no event shall The Daily Skillet, its directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use, goodwill or other intangible losses, arising from your access to or use of the Service.

Our total aggregate liability is limited to US $100.00. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify and hold harmless The Daily Skillet and its officers, directors, employees, agents and affiliates from and against any claims, damages, obligations, losses, liabilities, costs or expenses (including reasonable attorneys' fees) arising from:

a. your use of or access to the Service; b. your violation of these Terms; c. your infringement of any third party's rights.

12. Account suspension and termination

The Service currently does not require an account for general access. If we introduce accounts in the future:

  • We reserve the right, in our sole discretion and without prior notice, to suspend, deactivate or terminate accounts, including where we believe you have violated these Terms.
  • Your right to use the Service terminates immediately upon termination.
  • You may request deletion or deactivation of your account at any time by contacting [email protected]; we will delete the account and associated personal data as described in our Privacy Policy, subject to legal retention requirements.
  • Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitations of liability, indemnification and governing law.

13. Changes to these terms

We reserve the right to modify or replace these Terms at any time, in our sole discretion. We will endeavor to provide at least 30 days' notice before material changes take effect, by updating the "Last updated" date at the top of this page and posting a notice of the change on the site. Continued use of the Service after revisions take effect constitutes acceptance; if you do not agree, please stop using the Service.

14. Dispute resolution

a. Informal resolution. Before initiating any formal proceedings, the parties agree to attempt in good faith to resolve the dispute. The complaining party must provide written notice of the dispute, and both parties will attempt to resolve it within 60 days.

b. Binding arbitration. If the dispute is not resolved within 60 days, it shall be finally and exclusively resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring a claim in small claims court. The arbitration will be conducted by a single arbitrator, in English. The award may be enforced in any court of competent jurisdiction.

c. Class action waiver. Arbitration proceeds solely on an individual basis. Both parties expressly waive the right to bring class, collective or consolidated proceedings.

d. Equitable relief. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information, without the requirement to arbitrate first.

15. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict-of-law provisions. Subject to Section 14, the exclusive jurisdiction and venue for any litigation is the state and federal courts located in the State of Delaware, and both parties irrevocably submit to that exclusive jurisdiction and waive any objection based on inconvenient forum.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the complete and exclusive agreement between you and us regarding the Service, and supersede any prior or contemporaneous agreements, communications and understandings, whether oral or written.

17. Severability

If any provision of these Terms is held invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

18. Waiver

A failure by either party to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver is effective unless signed in writing by an authorized representative.
